Omaha, Nebraska driving and Taking CBD: Is it Safe?

CBD was made legal under the Farm Bill of 2018. However, the enforcement of this bill remains uneven throughout the country. In some states you can buy CBD at the pharmacy, while Nebraska’s attorney general recently issued a memorandum noting that CBD remains illegal to possess, manufacture, distribute, dispense, and sell, according to Omaha Magazine. The only exception to these laws is the use of CBD for the treatment of epileptic seizures and for the treatment of a rare form of epilepsy. The FDA has approved CBD for the treatment of epilepsy, but it has not approved CBD to treat any other medical condition. Despite this, there have been reports and some studies about the effectiveness of CBD in treating pain and certain conditions. According to Harvard Health Publishing, many people take CBD to treat insomnia, to manage pain, and to treat anxiety, though there haven’t been extensive medical studies on the effectiveness of CBD to treat these conditions. There have been limited studies on the effectiveness of CBD in helping patients manage arthritis pain and inflammation and in helping people who are suffering from neuropathic pain and inflammatory pain, two types of pain that are difficult to treat using traditional medicine.

However, like any drug, CBD can have side effects that can impact a person’s alertness and ability to drive. Harvard Health Publishing notes that CBD can leave a person feeling nauseous, fatigued, and irritable. So if you are wondering whether driving and taking CBD is safe, the short answer is that CBD can make you fatigued, which can potentially interfere with your ability to drive. And because the attorney general continues to crack down on CBD sale and distribution, if you are stopped for driving while under the influence of CBD or marijuana and are required to take a drug test, CBD and THC often trigger positive test results, so you could face charges of impaired driving for using THC. At the end of the day if you’ve been hurt in a car accident and suspect that the other driver might have been fatigued or under the influence of drugs, you may have the right to seek damages for your medical bills, rehabilitation costs, lost wages, and pain and suffering. Rensch & Rensch Law is a personal injury law firm in Omaha, Nebraska that may be able to investigate your case, identify negligent parties, and fight to help you get the settlement you may deserve under the law.

Drug Tests Can’t Tell the Difference Between CBD and THC

The New York Times recently reported that despite the fact that CBD is legal on the federal level, common drug tests used by law enforcement often can’t tell the difference between CBD and THC. This means that people could find themselves being accused of using marijuana or being under the influence of marijuana when they really had just taken CBD. At the end of the day, given the enforcement status of CBD in Nebraska, individuals should refrain from using CBD unless they have a prescription, until Nebraska sorts out its enforcement, and people should definitely not drive after using CBD products.

The reality is that CBD can interfere with a person’s driving ability if it has the potential to leave a person feeling fatigued. This means that if you were in an accident in Omaha, Nebraska and suspect that the other driver might have been under the influence of CBD, you may have the ability to seek damages for your medical expenses, lost wages, rehabilitation costs, and pain and suffering. Reach out to Rensch & Rensch Law, a personal injury law firm in Omaha, Nebraska today to learn more. Ultimately, every driver should get behind the wheel only if they are safe to do so and not under the influence of drugs or medicines that can interfere with their ability to drive.

You may only have a limited amount of time to seek damages under the law.
